📖 机构简介

香港证券及期货事务监察委员会（Securities and Futures Commission，简称 SFC）成立于 1989 年 5 月，是独立的法定机构，依据《证券及期货条例》负责监管香港证券、期货、杠杆式外汇交易及相关行业。SFC 独立于香港政府运作，只向香港立法会和终审法院负责。

作为亚太地区最严格的金融监管机构之一，SFC 与香港金管局（HKMA）、保险业监管局、强积金管理局共同构成香港四大金融监管体系。持 SFC 牌照的外汇经纪商在合规性、客户资金保护等方面标准极高。

⚖️ 监管职能与牌照类别

SFC 将金融业务分为 1-12 类牌照，外汇经纪商常涉及：

  • 第 1 类：证券交易
  • 第 2 类：期货合约交易（外汇期货相关）
  • 第 3 类：杠杆式外汇交易（零售外汇经纪商的核心牌照）
  • 第 4 类：证券咨询
  • 第 5 类：期货合约咨询
  • 第 9 类：资产管理

重点：香港合规的零售外汇经纪商必须持有第 3 类（杠杆式外汇交易）牌照，资本金要求为 3000 万港币，不能仅凭 1 类或 2 类牌照开展零售外汇业务。

🛡️ 投资者保护与维权机制

SFC 为投资者提供的保护机制：

  • 客户资金信托隔离：持牌中介人必须将客户资金存放于独立的客户信托账户，与公司自有资金完全分离
  • 投资者赔偿基金：经纪商违约时，每宗证券/期货交易的客户最高赔偿额为 HK$150,000（约合 1.9 万美元）
  • 杠杆限制：零售外汇杠杆上限 1:20
  • 风险披露要求：经纪商必须向客户充分披露外汇交易风险

维权渠道：① 向经纪商提出书面投诉；② 提交至 SFC 投诉单位（complaint@sfc.hk）；③ 金融纠纷调解中心（FDRC）免费调解，涉案金额上限 HK$500,000；④ 经纪商违约可向投资者赔偿基金申请赔偿。

  2. 搜索方式：
    • 按公司中文/英文名称搜索
    • 按 CE 编号（持牌人中央编号，6 位英数字组合）搜索
  3. 查看结果时重点关注：
    • 受规管活动：必须包含"第 3 类"（零售外汇经纪商）
    • 状态：Licensed/Registered，不能是 Revoked/Suspended
    • 发牌日期与条件：了解牌照有效期与限制条件

香港 SFC 第 3 类牌照有多难拿？
第 3 类牌照资本金要求 3000 万港币，并需配备合规主任、内审机制等。全港持有第 3 类牌照的机构不足 50 家，含金量极高。
如何辨别经纪商真的持有第 3 类牌照？
官方名册查询时确认"受规管活动"栏目必须列出"类别 3：杠杆式外汇交易"，其他类别（如 1/2 类）不能从事零售外汇业务。
被香港经纪商欺诈怎么办？
可向 SFC 投诉（complaint@sfc.hk）或金融纠纷调解中心（FDRC）申请免费调解，涉案金额 HK$500,000 以下。
